The Social Fund (Cold Weather Payments) (General) (Amendment) Regulations (Northern Ireland) 2009

The Department for Social Development makes the following Regulations in exercise of the powers conferred by sections 134(2) and 171(1), (3) and (4) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(1) and now vested in it(2).

Citation, commencement and interpretationN.I.

1.—(1) These Regulations may be cited as the Social Fund (Cold Weather Payments) (General) (Amendment) Regulations (Northern Ireland) 2009 and shall come into operation on 1st November 2009.

(2) In these Regulations “the principal Regulations” means the Social Fund (Cold Weather Payments) (General) Regulations (Northern Ireland) 1988(3).

(3) The Interpretation Act (Northern Ireland) 1954(4) shall apply to these Regulations as it applies to an Act of the Assembly.

Modification of the principal Regulations in respect of the 2009-10 winterN.I.

2.  For the purpose of making a payment in respect of a period of cold weather which begins at any time after 31st October 2009 but before 1st April 2010, regulation 3(5) (prescribed amount) of the principal Regulations is applied as if the reference to £8.50 were to £25.00.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations modify the Social Fund (Cold Weather Payments) (General) Regulations (Northern Ireland) 1988 (“the principal Regulations”).

Regulation 2 provides that for winter 2009/10 a cold weather payment will be £25 instead of £8.50.

These Regulations make in relation to Northern Ireland only provision corresponding to provision in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
