The Department of the Environment makes the following Regulations in exercise of the powers conferred by Articles 55(1) and 110(2) of the Road Traffic (Northern Ireland) Order 1995(1) and Articles 66(1) and 218(1) of the Road Traffic (Northern Ireland) Order 1981(2).

Citation and commencement

1.  These Regulations may be cited as the Public Service Vehicles (Conditions of Fitness, Equipment and Use) (Amendment No. 2) Regulations (Northern Ireland) 2009 and shall come into operation on 4th December 2009.

Amendment of the Public Service Vehicles (Conditions of Fitness, Equipment and Use) Regulations (Northern Ireland) 1995

2.  For regulation 36 of the Public Service Vehicles (Conditions of Fitness, Equipment and Use) Regulations (Northern Ireland) 1995(3) there shall be substituted—

36.  Not more than one passenger shall be carried in each front seat of the vehicle alongside the driver.

Revocation

3.  Regulation 39(2) of the Public Service Vehicles (Conditions of Fitness, Equipment and Use) Regulations (Northern Ireland) 1995 is hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Public Service Vehicles (Conditions of Fitness, Equipment and Use) Regulations (Northern Ireland) 1995 (S.R. 1995 No. 447) so as to clarify that not more than one passenger shall be carried in each front seat of the vehicle alongside the driver and to revoke regulation 39 (2) which relates to the requirement for a restrictor to be fitted to a sliding door.
