The Lord Chancellor makes the following Rules in the exercise of powers conferred by Article 359 of the Insolvency (Northern Ireland) Order 1989 (“the Order”)1 as amended by sections 160 and 167 of the Banking Act 20092 (“the 2009 Act”), with the concurrence of the Treasury and, in relation to those rules that affect court procedure, with the concurrence of the Lord Chief Justice of Northern Ireland under Article 359 (1A) of the Order.

The Lord Chancellor has not consulted the Committee existing for the purposes of Article 360 of the Order: this is the first exercise of the power in Article 359 of that Order, as amended by section 160 of the 2009 Act, and is therefore excluded from the requirement to consult by section 160(6) of the 2009 Act.
