7.—(1) The Pollution Prevention and Control Regulations (Northern Ireland) 2003(1) are amended with effect from 14 February 2011 as follows.
(2) In regulation 2(2) for the definition of “the Solvent Emissions Directive” substitute—
““the Solvent Emissions Directive” means Council Directive 1999/13/EC of 11 March 1999 on the limitation of emissions of volatile organic compounds due to the use of organic solvents in certain activities and installations as amended by Directive 2008/112/EC of 16 December 2008 amending Council Directives 76/768/EEC, 88/378/EEC, 1999/13/EC and Directives 2002/53/EC, 2002/96/EC, and 2004/42/EC of the European Parliament and of the Council in order to adapt them to Regulation (EC) No1272/2008 on classification, labelling and packaging of substances and mixtures.”
(3) In regulation 2(2) for the definition of “mixture” substitute—
““mixture” means a mixture or solution composed of two or more substances.”
(4) in the following provisions for “preparation” or “preparations” substitute “mixture” or “mixtures” respectively —
(a)Schedule 1, Part 1, Chapter 6, Section 7, Part C;
(b)Schedule 1, Part 2 , Paragraph 14(2);
(c)Schedule 5 “Air”, Paragraph 12; and
(d)Schedule 5 “Water”, Paragraph 4.
(5) In Schedule 1, Part 1, Chapter 6, Section 7, Part C—
(a)in the first column of the table for “risk phase R40” substitute “risk phrases R40 or R68”;
(6) In Schedule 3, Part 1, paragraph 5(3) for “the Solvent Emissions Regulations (Northern Ireland) 2003” substitute “the Solvent Emissions Regulations (Northern Ireland) 2004”.]
