Offences relating to E-marks15.

(1)

A person who, in the course of carrying on a business—

(a)

marks a package or outer container with the E-mark and is neither the packer nor the importer of the package or outer container, nor a person acting on behalf of the packer or importer,

(b)

marks a package or outer container with a mark so closely resembling the E-mark as to be likely to deceive, or

(c)

marks a package or outer container with the E-mark otherwise than as permitted by these Regulations,

shall be guilty of an offence.
