The Health (2006 Act) (Commencement) Order (Northern Ireland) 2012

The Department of Health, Social Services and Public Safety makes the following Order, in exercise of the powers conferred on it by section 83(6) of the Health Act 2006(1).

Citation and interpretation

1.—(1) This Order may be cited as the Health (2006 Act) (Commencement) Order (Northern Ireland) 2012.

(2) In this Order “the Act” means the Health Act 2006.

Appointed day for provisions relating to the supervision and management of controlled drugs

2.  1st August 2012 is the appointed day for the coming into operation of –

(a)Chapter 1 of Part 3 of the Act as it applies in relation to Northern Ireland, in so far as it is not already in operation(2); and

(b)Sections 76 and 77 of the Act, in so far as they relate to offences under Chapter 1 of Part 3 (including offences created in regulations under that Chapter).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order commences Chapter 1 of Part 3 of the Health Act 2006, in relation to Northern Ireland and sections 76 and 77 of that Act so far as they relate to offences under that Chapter 1 of Part 3 (including offences created in regulations under that chapter). Chapter 1 of Part 3 contains measures relating to the safe management and use of controlled drugs in certain health and social care settings. In particular, it provides for the appointment of accountable officers who are to ensure that specified organisations have appropriate arrangements for the safe and effective handling of controlled drugs, and it contains duties of collaboration between responsible bodies and rights of entry and inspection to relevant premises.

The provisions of the Act listed in the table below have been brought into operation in relation to Northern Ireland by commencement orders made by the Secretary of State.
