The Criminal Justice (Northern Ireland) Order 2008 (Commencement No. 9) Order 2015

The Department of Justice makes the following Order, in exercise of the powers conferred by Article 1(4) of the Criminal Justice (Northern Ireland) Order 2008 (1) and now vested in it (2).

Citation

1.—(1) This Order may be cited as the Criminal Justice (Northern Ireland) Order 2008 (Commencement No. 9) Order 2015.

(2) In this Order, “the 2008 Order” means the Criminal Justice (Northern Ireland) Order 2008.

Appointed Day

2.  The day appointed for the coming into operation of the following provisions of the 2008 Order is 1 July 2015 —

(a)Article 22 (duration of licences: prisoners serving indeterminate custodial sentences) in so far as it is not already in operation;

(b)Article 24(2) (licence conditions) in so far as it relates to Article 19;

(c)Article 24(7)(a) (licence conditions) in so far as it relates to Article 26;

(d)Article 26(2) (curfew condition to be included in licence under Article 19);

(e)Article 28 (recall of prisoners on licence) in so far as it is not already in operation

(f)Article 29 (further release after recall for certain fixed term prisoners) in so far as it is not already in operation.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into operation Articles 22, 24(2), 24(7)(a), 26(2), 28 and 29 of the Criminal Justice (Northern Ireland) Order 2008 on 1 July 2015. These provisions provide for the release and recall of certain categories of prisoners, and for licence conditions to be placed upon them including a curfew. They also provide for the release of certain categories of prisoners on compassionate grounds and for the further release of persons released under Article 20 and subsequently recalled.

Article 4(1) of and paragraph 32 of Schedule 1 to the Northern Ireland Act 1998 (Devolution of Policing and Justice Functions) Order 2010 (S.I. 2010/976) transferred the functions of the Secretary of State under Article 1(4) of the Criminal Justice (Northern Ireland) Order 2008 to the Department of Justice in Northern Ireland.
