The Department of Agriculture and Rural Development(1) in exercise of the powers conferred by Articles 10(6), 19, and 60(1) of the Diseases of Animals (Northern Ireland) Order 1981(2), makes the following Order.

Citation and commencement

1.  This Order may be cited as the Brucellosis Control (Amendment) Order (Northern Ireland) 2015 and shall come into operation on 28th September 2015.

Revocations

2.—(1) In the Brucellosis Control Order (Northern Ireland) 2004(3)—

(a)Part III; and

(b)Article 20(2)

are revoked.

(2) The Brucellosis Control (Amendment) Order (Northern Ireland) 2014(4) is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order further amends the Brucellosis Control Order (Northern Ireland) 2004 (“the 2004 Order”) by revoking the provisions in Part III of that Order prohibiting the movement of animals into or out of a herd, except directly to a slaughterhouse, unless the animals have been subjected to an official test prior to the date of movement.

This Order in addition revokes the power of the Department in Article 20(2) of the 2004 Order to include in licences for draft or dispersal sales a provision requiring that animals in the sales shall have undergone an official test with negative results.

The Order also revokes the Brucellosis Control (Amendment) Order (Northern Ireland) 2014 which had previously amended Part III and Article 20(2) of the 2004 Order.
