Notice of reference of applications to the Department10
Where the Department has given a direction under section 29 (call in of applications, etc., to the Department) of the 2011 Act that an application for planning permission made to a council is to be referred to it to be dealt with rather than by the council, the council must serve on the applicant notice—
a
of the terms of the direction;
b
of any reasons given by the Department for requiring the application to be referred to it;
c
that the application has been referred to the Department; and
d
that the decision of the Department on the application will be final.
