Amendment to the Penalty Notices (Justice Act (Northern Ireland) 2011) (Enforcement of Fines) Regulations (Northern Ireland) 201233

The Penalty Notices (Justice Act (Northern Ireland) 2011) (Enforcement of Fines) Regulations (Northern Ireland) 201234 are amended as follows.

In regulation 2, omit the definitions of “county court division” and “petty sessions district”.

Omit regulation 3(2).

For regulation 4(2), substitute—

A magistrates’ court may, upon complaint made by the clerk of petty sessions, at any time after the expiration of 14 days from the due date and before the expiration of 6 months from that date—

a

issue and cause to be served on the defendant a summons for the appearance of the defendant before a court of summary jurisdiction; or

b

by warrant cause the defendant to be brought before a court of summary jurisdiction.

In regulation 6(5), for the words from “a court acting” to the end, substitute “a court of summary jurisdiction”.

In Schedule 1, in paragraph (a), for “the court of summary jurisdiction acting for the petty sessions district of ….”, substitute “a court of summary jurisdiction.”.
