The Department of Agriculture, Environment and Rural Affairs(1)—
(a)being a Department designated(2), for the purposes of making Regulations under section 2(2) of the European Communities Act 1972(3) in relation to food (including drink) including the primary production of food; and
(b)having carried out the consultation required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety(4),
makes these Regulations in accordance with section 2(2) of the European Communities Act 1972.
1.—(1) These Regulations may be cited as the Beef and Veal Labelling (Amendment) Regulations (Northern Ireland) 2018 and shall come into operation on 17th December 2018.
(2) The Interpretation Act (Northern Ireland) 1954(5) shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.
2.—(1) The Beef and Veal Labelling Regulations (Northern Ireland) 2010(6) are amended as follows.
(2) In regulation 3—
(a)after “Title II of Regulation 1760/2000”, insert “as last amended by Regulation (EU) 2016/429 of the European Parliament and of the Council(7)”;
(b)after “Commission Regulation 566/2008”, insert “as last amended by Commission Implementing Regulation (EU) 565/2013(8)”.
(3) In regulation 5(1), omit sub-paragraphs (a) (vii) and (viii).

These Regulations amend the Beef and Veal Labelling Regulations (Northern Ireland) 2010 to update legislative references and to reflect provisions in Regulation (EU) No 652/2014 of the European Parliament and of the Council amending Regulation (EC) No 1760/2000 as regards electronic identification of bovine animals and labelling.
Regulation 2(2) (a) and (b) updates references to EU legislation by amending regulation 3 (The Competent Authority).
Regulation 2(3) removes the requirement for businesses to seek prior approval from the Department before labelling beef and veal with non-compulsory information by amending regulation 5 (Offences).
Formerly the Department of Agriculture and Rural Development (DARD see Article 3(4) of the Departments (Northern Ireland) Order 1999 (S.I. 1999/283 (N.I. 1). DARD was renamed the Department of Agriculture, Environment and Rural Affairs by Article 1(2) of the Departments (Northern Ireland) Act 2016 (2016 c.5 (N.I.)).
