Coming into operation

The Department for Infrastructure, being a Department designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the environment makes the following Regulations in exercise of the powers conferred by that Section.

Citation and commencement1

These Regulations may be cited as the Water Environment (Floods Directive) (Amendment No. 2) Regulations (Northern Ireland) 2018 and shall come into operation on 21st December 2018.

Amendment to the Water Environment (Floods Directive) Regulations (Northern Ireland) 20092

The Water Environment (Floods Directive) Regulations (Northern Ireland) 20093 are amended as follows.

In regulation 12(2)(c) omit “referred to in Annex 1 to Directive 2008/1/EC of the European Parliament and of the Council concerning integrated pollution prevention and control”.

In regulation 12(3) substitute “regulation 8(2) of the 2003 Regulations” with “regulation 2 of the 2017 Regulations4”.

In regulation 17(1)(a)(viii) substitute “the Planning (Northern Ireland) Order 1991” with “the Planning Act (Northern Ireland) 20115”.

In Schedule 3, Part 1 Paragraph 4—

a

in sub paragraph (a) substitute “Council Directive 85/337/EEC” with “Council Directive 2011/92/EU6, as amended by Directive 2014/52/EU7”;

b

in sub paragraph (b) substitute “Council Directive 96/82/EC” with “Council Directive 2012/18/EU8”.
