The Food (Miscellaneous Amendments and Revocations) Regulations (Northern Ireland) 2019

Coming into operation

The Department of Health1 being a department designated for the purposes of section 2(2) of the European Communities Act 19722 in relation to measures relating to food (including drink) including the primary production of food3 makes the following Regulations in exercise of the powers conferred by Article 15(1), 16(2) and 47(2) of the Food Safety (Northern Ireland) Order 19914 and section 2(2) of, and paragraph 1A of Schedule 2 to the European Communities Act 1972.

These Regulations make provision for a purpose mentioned in section 2(2) of the European Communities Act 1972 and it appears to the Department of Health that it is expedient for references to specified EU instruments or provisions of EU instruments in specified statutory rules to be construed as references to those EU instruments, or provisions of EU instruments as amended from time to time, as provided for in regulations 7(5)(b) and 24 of these Regulations.

In accordance with Article 47(3A) of the Food Safety (Northern Ireland) Order 1991, the Department of Health has had regard to relevant advice given by the Food Standards Agency.

There has been open and transparent public consultation during the preparation of these Regulations in accordance with the requirements of Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety5 as last amended by Regulation (EU) 2017/745 of the European Parliament and of the Council6.
