(1)
F2Subject to paragraph (2) a person responsible for carrying on a retail business, which is not wholly or mainly a retail business listed in paragraph (2) of schedule 1, of offering goods for sale or for hire or providing a service must—
F3(a)
cease to carry on that business or provide that service except—
(i)
by making deliveries in response to requests received by on-line communication, by telephone, by text message or by post (provided that no person attends the premises of the business to collect goods or avail of a service); or
(ii)
in the case of a car dealership which is a Motability dealer, by permitting a customer to collect a Motability vehicle following an on-line application (provided that F4no person other than the customer’s carer accompanies the customer);
(b)
close any premises which are not required to carry out its business or provide its services as permitted by sub-paragraph (a); and
(c)
cease to admit any person to its premises who is not required to carry on its business or provide its service as permitted by sub-paragraph (a).
F5(2)
(a)
This paragraph applies to a retail business which is a shop which sells baby equipment, clothing, footwear or electrical goods F6, or which is a garden centre or a plant nursery.
(b)
A person responsible for carrying on a retail business to which this paragraph applies may supply goods specified in sub-paragraph (a), which have been—
(i)
requested by on-line communication, by telephone, by text message or by post; and
(ii)
paid for in advance;
to a customer who attend the shop to collect the goods.
