4B.—(1) [F2Subject to paragraph (2) a person] responsible for carrying on a retail business, which is not wholly or mainly a retail business listed in paragraph (2) of schedule 1, of offering goods for sale or for hire or providing a service must—

[F3(a)cease to carry on that business or provide that service except—

(i)by making deliveries in response to requests received by on-line communication, by telephone, by text message or by post (provided that no person attends the premises of the business to collect goods or avail of a service); or

(ii)in the case of a car dealership which is a Motability dealer, by permitting a customer to collect a Motability vehicle following an on-line application (provided that [F4no person other than the customer’s carer accompanies the customer]);]

(b)close any premises which are not required to carry out its business or provide its services as permitted by sub-paragraph (a); and

(c)cease to admit any person to its premises who is not required to carry on its business or provide its service as permitted by sub-paragraph (a).

[F5(2) (a) This paragraph applies to a retail business which is a shop which sells baby equipment, clothing, footwear or electrical goods [F6, or which is a garden centre or a plant nursery].

(b)A person responsible for carrying on a retail business to which this paragraph applies may supply goods specified in sub-paragraph (a), which have been—

(i)requested by on-line communication, by telephone, by text message or by post; and

(ii)paid for in advance;

to a customer who attend the shop to collect the goods.]]
