2.  In these Regulations—

[F1“a person responsible for a relevant place” includes the owner, proprietor, tenant or manager of the relevant place;]

[F2“Bus” means a motor vehicle which is constructed or adapted to carry more than eight seated passengers in addition to the driver;]

[F2“Coach” means a large bus with a maximum gross weight of more than 7.5 tonnes and with a maximum speed exceeding 60 mph;]

face covering” means a covering of any type which covers a person's nose and mouth;

emergency responder” has the meaning given by section 153A(6) of the Inheritance Tax Act 1984 M1;

[F4“junior pupil” has the meaning given by sub-section 2(2) of the Education and Libraries (Northern Ireland) Order 1986]

passenger transport service” means—

(a)

bus, coach and rail services delivered under a Public Service Agreement, Bus Service Permit or Cross-border Authorisation issued by the Department for Infrastructure M2 under section 1 of the Transport Act (Northern Ireland) 2011 M3 or in accordance with Regulation (EC) No 1073/2009 of the European Parliament and of the Council of 21 October 2009 on Common Rules for Access to the International Market for Coach and Bus Service M4;

(b)

ferry services operated in accordance with the Strangford Lough Ferry and Harbour Byelaws (Northern Ireland) 1988 M5 or in pursuance of an agreement under Article 99 of the Roads (Northern Ireland) Order 1993 M6;

(c)

services provided by community transport operators funded by the Department for Infrastructure under Part 5 of the Transport Act (Northern Ireland) 2011;

(d)

[F5a service provided for the carriage of passengers by air;]

passenger transport service premises” means off-road premises where a passenger transport service may stop or terminate, allowing passengers on and off [F6, and an airport];

relevant person” has the meaning given by regulation 6(8)(b);

[F1“relevant place” means a place listed in [F7paragraph 1 of] the Schedule;]

school transport service” means any transport provided solely for the purpose of—

(a)

facilitating a person's attendance at a school or other place at which they receive education or training; or

(b)

otherwise than for the reason in paragraph (a), carrying a person to and from the school or other place at which they receive education or training.

[F2“Taxi” means a motor vehicle constructed or adapted to carry not more than 8 passengers in addition to the driver—

(a)

which is used in standing or plying for hire or reward; or

(b)

which is provided with the services of a driver and is used to carry passengers for hire or reward in the course of business of carrying passengers, but does not include any vehicle in respect of which a certificate of exemption in the prescribed form has been issued by the Department for Infrastructure or any vehicle to which Article 66A of the Road Traffic (Car-Sharing Arrangements) (Northern Ireland) Order 1981 applies;]

[F2“Test of competence to drive” means the test established by Article 5 of the Road Traffic (Northern Ireland) Order 1981;]

[F8“vehicle” has the meaning given by Article 3(1) of The Road Traffic (Northern Ireland) Order 1995;

“vehicle testing centre” and “vehicle examiner” have the meaning given by Articles 73 and 74 of The Road Traffic (Northern Ireland) Order 1995;]

[F9For the purpose of these regulations, a relevant place includes any indoor or outdoor area where seating or tables are made available for the consumption of food or drink by customers of the business carried on in the relevant place.]
