The Health Protection (Coronavirus, International Travel) (Amendment No. 7) Regulations (Northern Ireland) 2020

Coming into operation

at 4.00 a.m. on 22nd August 2020

The Department of Health(1) makes the following Regulations in exercise of the powers conferred by sections 25B and 25F(2) of the Public Health Act (Northern Ireland) 1967(2).

Citation and commencement

1.  These Regulations may be cited as the Health Protection (Coronavirus, International Travel) (Amendment No. 7) Regulations (Northern Ireland) 2020 and shall come into operation at 4.00 am on 22nd August 2020.

Amendment of the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2020

2.—(1) The Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2020(3) are amended in accordance with regulations 3 and 4.

(2) In relation to any person who arrived in Northern Ireland on or after 10th July 2020 and before the coming into operation of any amendment made by regulation 4 the principal Regulations apply as if that amendment had not been made.

Amendments to Schedule 2

3.  In Schedule 2 (persons not required to comply with regulations 3 or 4)—

(a)in paragraph 39(2), in the definition of “domestic elite sportsperson”—

(i)for paragraph (a), substitute—

(a)is an elite athlete,;

(ii)after paragraph (a), insert—

(aa)“elite athlete” means an individual who—

(i)derives a living from competing in a sport,

(ii)plays in a professional league or competition,

(iii)is a senior representative nominated by a relevant sporting body,

(iv)is a member of the senior training squad for a relevant sporting body, or

(v)is aged 16 or above and on an elite development pathway,;

(b)in paragraph 39(3), for “definition of “international elite sportsperson”” substitute “definitions of “international elite sportsperson” and “domestic elite sportsperson””.

Amendments to Schedule 3

4.  In Schedule 3(4) (exempt countries and territories)—

(a)at the appropriate place in alphabetical order, insert “Portugal”; and

(b)omit “Austria”, “Croatia”, and “Trinidad and Tobago”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2020 (“The International Travel Regulations”).

A definition of “elite athlete” is inserted as the definition relied on in the Health Protection (Coronavirus, Restrictions) Regulations (Northern Ireland) 2020 (S.R. 2020 No. 55) has been revoked.

Portugal is added to the list of countries and territories in Schedule 3 to the International Travel Regulations exempt from the requirement in regulation 4 of those Regulations to self-isolate for 14 days after arrival in Northern Ireland

Austria, Croatia, and Trinidad and Tobago are omitted from the list of countries and territories in Schedule 3 to the International Travel Regulations exempt from the requirement in regulation 4 of those Regulations to self-isolate for 14 days after arrival in Northern Ireland

No impact assessment has been prepared for these Regulations.
