A person guilty of an offence under regulation 40(1), 41, 43, 44 or 45 is liable on summary conviction to a fine not exceeding level 5 on the standard scale.

A person guilty of an offence under regulation 46 is liable—
a
on summary conviction, to imprisonment for a term not exceeding three months, to a fine not exceeding the statutory maximum or to both;
b
on conviction on indictment, to imprisonment for a term not exceeding two years, to a fine or to both.
