Citation and commencementN.I.
1.—(1) These Regulations may be cited as the Health Protection (Coronavirus, International Travel, Operator Liability and Information to Passengers) Regulations (Northern Ireland) 2021.
(2) These Regulations come into operation at 4.00 am on 16th April 2021.
InterpretationN.I.
2. In these Regulations—
“child” means a person under the age of 18;
“the common travel area” has the meaning given in section 1(3) of the Immigration Act 1971 M1 (the United Kingdom, the Channel Islands, the Isle of Man and the Republic of Ireland);
“
” means severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2),“
” means COVID-19 (the official designation of the disease which can be caused by coronavirus);“defaulting passenger” means a passenger who fails, without reasonable excuse—
to provide evidence of having provided passenger information when requested to do so by an immigration officer in accordance with regulation 4(7) of the International Travel Regulations,
to produce a valid notification of a negative test result from a qualifying test when requested to do so by an immigration officer in accordance with regulation 6(6) of the International Travel Regulations,
to provide evidence of possessing a testing package when requested to do so by an immigration officer in accordance with regulation 8(10) of the International Travel Regulations, and
to provide evidence of possessing a managed isolation package when requested to do so by an immigration officer in accordance with paragraph 16 of Schedule 7 to the International Travel Regulations;
“designated port” has the meaning set out in Schedule 7 to the International Travel Regulations;
“immigration officer” means a person appointed by the Secretary of State as an immigration officer under paragraph 1 of Schedule 2 to the Immigration Act 1971 M2;

“International Travel Regulations” means the Health Protection (Coronavirus, International Travel) Regulations (Northern Ireland) 2021 M3;
“operator” means the operator of a relevant service;
“port” means any port (including a seaport, airport or heliport) in Northern Ireland;
“passenger” means a person travelling on a conveyance who is not a member of the conveyance's crew;
“Passenger Locator Form” has the meaning given in regulation 2(1) of the International Travel Regulations;
“relevant service” means a commercial transport service carrying passengers to Northern Ireland from outside the common travel area;
“required negative notification” means [F2notification provided through the EU Digital [F3COVID] Certificate or] notification of the result of a test for the detection of coronavirus which satisfies paragraph 3 of Schedule 5 to the International Travel Regulations;

“the requirement to possess notification of a negative test result” means the requirement in regulation 6 of the International Travel Regulations;
“the requirement to provide information” means the requirement in regulation 4 of the International Travel Regulations;
