The Agriculture (Student fees) (Amendment) (No. 2) Regulations (Northern Ireland) 2021

Coming into operation-

The Department of Agriculture, Environment and Rural Affairs1, in exercise of the powers conferred by section 5A(1) and (2) of the Agriculture Act (Northern Ireland) 19492, makes the following Regulations:

Citation and commencement1

These Regulations may be cited as the Agriculture (Student fees) (Amendment) (No. 2) Regulations (Northern Ireland) 2021 and shall come into operation on the 2nd August 2021.

Amendment to the Agriculture (Student fees) Regulations (Northern Ireland) 20072

The Agriculture (Student fees) Regulations (Northern Ireland) 20073 shall be amended as provided by regulation 3.

Amendment to regulation 43

In regulation 4, for paragraph (8)4 substitute—

Subject to regulation 5, where a person has been granted limited leave to enter or remain (“pre-settled” status) or indefinite leave to enter or remain (“settled” status) under the EU Settlement Scheme contained in Appendix EU to the immigration rules5, the fee payable to the Department is set out in paragraph (1).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Agriculture (Student fees) Regulations (Northern Ireland) 2007.

Regulation 3 replaces regulation 4(8) with an enhanced definition of the terms ‘EU Settlement Scheme’, ‘pre-settled’ status and ‘settled’ status. The EU Settlement Scheme referred is provided under Appendix EU to the immigration rules.
