Requirement to close premisesN.I.

3.—(1) For the purposes of this regulation, “listed premises” and “listed businesses” means the premises and businesses listed in [F1part 1] of Schedule 1.

[F2(2) A person responsible for listed premises or a listed business must close those premises or that business.]

(3) Where listed premises or a listed business form part of larger premises or business, the person responsible for those larger premises or business complies with paragraph (1) by closing the listed premises or listed business.

[F64.(1) This regulation applies to the following premises—

(a)theatres;

(b)concert halls; F7...

(c)indoor venues, other than private dwellings and those set out in subparagraphs (a) and (b), when used for the purpose of a performance, recording or rehearsal [F8; and]

(2) A person responsible for organising or operating an indoor gathering in any venue to which this regulation applies must take reasonable steps to—

(c)prevent persons attending an event from moving within the premises other than to enter or exit the premises, access a seat [F13, access an exhibition stand or exhibit,] make a payment, [F14place or collect an order for food or drink (including intoxicating liquor), access a buffet or carvery, play a gaming machine, play a game such as pool, snooker or darts or dance at an event to celebrate a wedding or civil ceremony,] or access and use toilet, baby changing or breast feeding facilities or a smoking area;

(d)ensure there is no dancing by visitors to the venue [F15except at an event to celebrate a marriage or civil partnership];

(e)carry out a risk assessment which complies with the requirements of regulation 9(5)(a) and which determines the maximum number of persons who may be seated in each part of the venue;

(f)retain the risk assessment referred to in subparagraph (e) on the premises and make it available immediately for inspection by visitors to the premises or to a relevant person on request;

(g)display prominently, at each part of the venue, the maximum number of persons who may be seated in that part of the venue;

(h)limit the risk of transmission of the coronavirus in accordance with regulation 9(5)(b);

(i)comply with the duty in regulation 15 (Visitor and Attendee Information);

(j)comply with the duty in regulation 17 (Requirement in relation to social distancing); F16...

[F46(3) (a) This paragraph applies to premises which are specified in an occasional licence granted under article 30 of the Licensing (Northern Ireland) Order 1996 and which are wholly or mainly outdoors.

(b)A person responsible for carrying on a business or a members’ club at premises to which this paragraph applies must –

(i)carry out a risk assessment which complies with the requirements of regulation 9(5)(a);

(ii)retain the risk assessment referred to in head (i) on the premises and make it available immediately for inspection by visitors to the premises or to a relevant person on request; F47...
