The Equine Identification (Amendment) Regulations (Northern Ireland) 2022

The Department of Agriculture, Environment and Rural Affairs makes these Regulations in exercise of the powers conferred by sections 11 and 22 of and Part 1C of Schedule 2 and paragraphs 8F and 21(b) of Schedule 7 to, the European Union (Withdrawal) Act 2018(1).

Citation, commencement and interpretationN.I.

1.—(1) These Regulations may be cited as the Equine Identification (Amendment) Regulations (Northern Ireland) 2022 and come into operation on 31st August 2022.

(2) The Interpretation Act (Northern Ireland) 1954(2) applies to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendments to the Equine Identification Regulations (Northern Ireland) 2019N.I.

2.—(1) The Equine Identification Regulations (Northern Ireland) 2019(3) are amended as follows.

(2) In regulation 2(2) for the definition of “Commission Implementing Regulation” substitute—

Commission Delegated Regulation” means Commission Delegated Regulation (EU) 2019/2035 of 28 June 2019 supplementing Regulation (EU) 2016/429 of the European Parliament and of the Council as regards rules for establishments keeping terrestrial animals and hatcheries, and the traceability of certain kept terrestrial animals and hatching eggs.

(3) In each of the following provisions—

(a)in regulation 2(2)—

(i)in the definition of “issuing body”;

(ii)in the definition of “passport”;

(b)regulation 2(3) and (4);

(c)the heading and text of regulation 3;

(d)regulation 4;

(e)regulation 14(1), (2) (3) and (4);and

(f)regulation 17(1)

for “Commission Implementing Regulation” substitute “Commission Delegated Regulation”.

(4) In regulation 6 for “Article 3(3) and Article 11(1)” substitute “Article 58(3)”.

(5) In regulation 7, for the words from “of Article 15(2)” to the end substitute “of Title IV of Part III of the Commission Delegated Regulation”.

(6) In regulation 8(2) omit—

(a)“For the purposes of Article 18(5)”; and

(b)“in accordance with Articles 4(2) or 43(1)”.

(7) In regulation 9 for “the measures set out in Article 17(1)” substitute “sufficient measures”.

(8) In regulation 10—

(a)for “Article 23(1)” substitute “Article 66(1)”;

(b)in paragraph (a) for “Article 23(2)” substitute “Article 66(2)”;

(c)in paragraph (b) omit “issued in accordance with Article 25(1)”; and

(d)in paragraph (c) omit “issued in accordance with Article 24(1)”.

(9) In regulation 11 omit “whether pursuant to Article 27 or otherwise”.

(10) In regulation 12 omit “in accordance with Article 34(1)( c)(ii)”.

(11) In regulation 13—

(a)for paragraph (1) substitute —

(1) An issuing body must incorporate the information falling within Article 109(1) (d) (i) to (iii) of Regulation EU 2016/429 in to the database established under that Article.

(b)Omit paragraph (4).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made in exercise of the powers in sections 11 and 22 of, and Part 1C of Schedule 2 and paragraphs 8F and 21(b) of Schedule 7 to, the European Union (Withdrawal) Act 2018.

They amend domestic legislation relating to equine identification in order to update references to European Legislation.

No Impact Assessments were produced in relation to these regulations as no, or no significant, impact on the private or voluntary sector is foreseen.
