The Department of Agriculture, Environment and Rural Affairs being a devolved authority 1, makes these regulations in exercise of the powers conferred by sections 11 of, and paragraph 1(1) of Schedule 2 and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018 2:

These Regulations may be cited as the Sulphur Content of Solid Fuel (Amendment) Regulations (Northern Ireland) 2022 and shall come into operation on 18th November 2022.

The Sulphur content of Solid Fuel Regulations (Northern Ireland) 19983 amended as follows.

For regulation 3(1) substitute—

Subject to paragraph (2), a person shall not sell by retail or deliver in the course of retail sale any solid fuel having a total sulphur content greater than 2 per cent. Determined on a dry basis in accordance with British Standard BS 1016-106.4.2 Methods for analysis and testing of coal and coke. Ultimate analysis of coal and coke. Determination of total sulfur content. High temperature combustion method 4.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations are made in exercise of the powers conferred by section 11 of, and paragraph 1(1) of Schedule 2 and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018. The Regulations make amendments to the legislation in the field of air quality to remedy any failure of retained EU law to operate effectively.

Regulation 2 makes technical updating amendments to the Sulphur Content of Solid Fuel Regulation (Northern Ireland) 1998 by substituting a new British Standard for the determination of the total sulphur content.
