1.—(1) These Regulations may be cited as the Aquatic Animal Health (Amendment) Regulations (Northern Ireland) 2023 and come into operation on 30th October 2023.
(2) The Interpretation Act (Northern Ireland) 1954(3) applies to these Regulations as it applies to an Act of the Assembly.
(3) In these Regulations—
“Directive 2006/88” means Council Directive 2006/88/EC on animal health requirements for aquaculture animals and products thereof, and on the prevention and control of certain diseases in aquatic animals(4).
2. The Aquatic Animal Health Regulations (Northern Ireland) 2009(5) are amended in accordance with regulations 3 to 12.
3.—(1) In regulation 2(2)—
(a)omit the definition of “aquatic animal”;
(b)omit the definition of “Commission Decision 2010/221”(6);
(c)in the definition of “listed disease”, for paragraph (a) substitute—
“(a)a disease listed in Annex II to Regulation 2016/429; or”
(d)after the definition of “Regulation 1251/2008”, insert—
““Regulation 2016/429” means Regulation (EU) 2016/429 of the European Parliament and of the Council on transmissible animal diseases and amending and repealing certain acts in the area of animal health(7);
“Regulation 2018/1882” means Commission Implementing Regulation (EU) 2018/1882 on the application of certain disease prevention and control rules to categories of listed diseases and establishing a list of species and groups of species posing a considerable risk for the spread of those listed diseases(8);
“Regulation 2020/990” means Commission Delegated Regulation (EU) 2020/990 supplementing Regulation (EU) 2016/429 of the European Parliament and of the Council, as regards animal health and certification requirements for movements within the Union of aquatic animals and products of animal origin from aquatic animals(9);”
(e)omit the definition of “transporter”.
(2) For regulation 2(3) substitute—
“(3) Any expression used in these Regulations which is also used in Regulation 2016/429 has the same meaning as it bears in that Regulation.”.
4. After regulation 4, insert—
4A. An aquatic animal health professional may—
(a)undertake activities assigned to veterinarians under Regulation 2016/429 in relation to aquatic animals; and
(b)be appointed to be an inspector for the purpose of these Regulations.”.
5. In regulation 14, omit paragraphs (2) and (3).
6. In regulation 19—
(a)in paragraph (8)(10)—
(i)for “the second column of Part II of Annex IV to Directive 2006/88” substitute “Annex II to Regulation 2016/429”; and
(ii)in sub-paragraph (b)(i)—
(aa)for “declared” substitute “recognised as”; and
(bb)for “Article 49 or 50 of Directive 2006/88” substitute “Article 36 or 37 of Regulation 2016/429”;
(b)in paragraph (9)—
(i)for “the second column of Part II of Annex IV to Directive 2006/88” substitute “Annex II to Regulation 2016/429”; and
(ii)in sub-paragraph (a)—
(aa)for “declared” substitute “recognised as”; and
(bb)for “Article 49 or 50 of Directive 2006/88” substitute “Article 36 or 37 of Regulation 2016/429”;
(c)for paragraphs (11)(a) and (b) substitute—
“(a)an aquaculture animal, mollusc or crustacean is of a species susceptible to a disease listed in Annex II to Regulation 2016/429 if it is of a species listed in the third column of the table in the Annex to Regulation 2018/1882 opposite the disease listed in the first column of that table;
(b)an aquaculture animal is a vector for a disease if—
(i)it is of a species listed in the fourth column of the table in the Annex to Regulation 2018/1882 opposite the disease listed in the first column of that table; and
(ii)where conditions relevant to that species are set out in the third column of the table in Annex I of Regulation 2020/990, opposite the disease listed in the first column, the animal fulfils such conditions.”.
7. In regulation 27—
(a)in paragraph (2)(b), for “Article 57 of Directive 2006/88” substitute “Article 54(2)(b) of Regulation 2016/429”; and
(b)in paragraph (2)(d), for “epizootic investigation in accordance with Article 29 of Directive 2006/88” substitute “epidemiological enquiry in accordance with Article 57(1) of Regulation 2016/429”.
8. In regulation 31(2)(d), for “Article 57 of Directive 2006/88” substitute “Article 54(2)(b) of Regulation 2016/429”.
9. In regulation 37(1), for “Directive 2006/88” substitute “Regulation 2016/429”.
10. Omit regulation 52.
11. In regulation 56(1), for “Directive 2006/88” substitute “Regulation 2016/429”.
12. In Schedule 1 for “(which are not listed in Part II of Annex IV to Directive 2006/88)” substitute “(which are not listed in Annex II to Regulation 2016/429)”.

These Regulations are made in exercise of the powers conferred by sections 11 and 22 of, and paragraphs 11M(1), (3) and (8) of Part 1C of Schedule 2 and paragraph 21(b) of Schedule 7, to the European Union (Withdrawal) Act 2018, to ensure that Northern Ireland subordinate legislation in respect of aquatic animal health is aligned with Regulation (EU) 2016/429 of the European Parliament and of the Council on transmissible animal diseases and amending and repealing certain acts in the area of animal health, in accordance with the Windsor Framework.
An impact assessment has not been produced for this Statutory Rule as no, or no significant impact on the private, voluntary or public sector is foreseen.
