The Department for Communities makes the following Regulations in exercise of the powers conferred by sections 134(1)(a) and 171(1) and (4) of the Social Security Contributions and Benefits (Northern Ireland) Act 1992(1), and now vested in it(2).

Citation and commencementN.I.

1.  These Regulations may be cited as the Social Fund Maternity and Funeral Expenses (General) (Amendment) Regulations (Northern Ireland) 2023 and shall come into operation on 11th December 2023.

Amendment of the Social Fund Maternity and Funeral Expenses (General) RegulationsN.I.

2.  In regulation 2(1)(3) (interpretation) of the Social Fund Maternity and Funeral Expenses (General) Regulations (Northern Ireland) 2005(4), in the definition of “parental order”, after “section 54” insert “or section 54A”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Social Fund Maternity and Funeral Expenses (General) Regulations (Northern Ireland) 2005 (“the Maternity and Funeral Expenses Regulations”) to reflect an amendment made to the Human Fertilisation and Embryology Act 2008, which allows for a sole applicant for a parental order, whereas previously only couples could apply.

Regulation 1 provides for citation and commencement.

Regulation 2 amends regulation 2(1) of the Maternity and Funeral Expenses Regulations to include section 54A of the Human Fertilisation and Embryology Act 2008.
