The Further and Higher Education (Scotland) Act 2005 (“the Act”) established the Scottish Further and Higher Education Funding Council and made provision relating to the funding of bodies which provide further and higher education. Those bodies are described in the Act as “fundable bodies” and are listed in schedule 2 to the Act.

This Order updates the list of fundable bodies by amending schedule 2 to the Act to address the change of name from Lauder College to Carnegie College, the change of name from Jewel and Esk Valley College to Jewel and Esk College, the merger of the University of Paisley and Bell College of Technology and the subsequent change of name from the University of Paisley to the University of the West of Scotland, which are given effect to respectively by the Bell College of Technology (Transfer and Closure) (Scotland) Order 2007 (S.S.I. 2007/171) and the University of the West of Scotland Order of Council 2007 (S.S.I. 2007/426). In terms of section 49 of the Act, the governing body of the University of Paisley resolved to change the name on 17th October 2006 and the Privy Council consented to the change of name by letter dated 18th July 2007.

Article 2(a) and (c) adds Carnegie College to and removes Lauder College from, respectively, the list of fundable bodies.

Article 2(b) substitutes Jewel and Esk College for Jewel and Esk Valley College on the list of fundable bodies.

Article 2(d) and (e) removes, respectively, Bell College of Technology and University of Paisley from the list of fundable bodies.

Article 2(f) adds the University of the West of Scotland to the list of fundable bodies.
