Coming into force

The Scottish Ministers, having received an application from the City of Edinburgh Council under paragraphs 1(1)(d) and 2(1)(c) of Schedule 3 to the Road Traffic Act 19911 and having consulted the Chief Constable of Lothian and Borders Police in accordance with paragraphs 1(3) and 2(3) of that Schedule, in exercise of the powers conferred by paragraphs 1(1), 2(1) and 3(3) of Schedule 3 to the said Act and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement1

This Order may be cited as the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Amendment Order 2002 and shall come into force on 17th May 2002.

Amendment to the 1998 Order2

Paragraph 1(3) of Schedule 2 of the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Order 19982 shall be omitted and there shall be substituted:

In subsection (2)–

a

the words “For the purposes of this Part of this Act”; and

b

paragraphs (a)(i), (b) and (c) shall be omitted.

This Order amends the Road Traffic (Permitted Parking Area and Special Parking Area) (City of Edinburgh) Designation Order 1998 by making a further modification to the provisions of the Road Traffic Act 1991. The effect of the modification is to make further provision with regard to when a penalty charge is payable.
