Part IXS Supplementary provisions

Service of notices and other documentsS

100.—(1) Any notice or other document to be given or served on any person under or in relation to these Regulations may be given or served either–

(a)by delivering it to that person;

(b)in the case of an incorporated body, by delivering it to their secretary or clerk at their registered or principal office, or by sending it by post to that person at that office; or

(c)in the case of any other person, by leaving it, or sending it by post to that person, at the usual or last known address of that person.

(2) Where a notice or other document is to be given or served on the owner, proprietor, operator or occupier of any premises and it is not practicable after reasonable enquiry to ascertain the name and address of the person to or on whom it should be given or served, or the premises are unoccupied, the document may be given or served by addressing it to the person concerned by the description of “owner”, “proprietor”, “operator” or “occupier” of the premises (naming them) and–

(a)by delivering it to some person on the premises; or

(b)if there is no person on the premises to whom it can be delivered, by affixing it, or a copy of it, to some conspicuous part of the premises.

AmendmentsS

101.  The amendments set out in Schedule 8 to these Regulations shall have effect.

Revocations and savings and transitional provisionsS

102.—(1) Subject to the savings and transitional provisions in the following provisions of this regulation, the enactments specified in the first column of Part I of Schedule 9 to these Regulations shall be revoked to the extent specified in the corresponding entry in the third column of that Schedule.

(2) Part II of Schedule 9 to these Regulations has effect for the purpose of making savings in respect of things done under the Bovine Spongiform Encephalopathy (No. 2) Order 1996 M1 and the Bovine Spongiform Encephalopathy Compensation Order 1996 M2 having effect at the coming into force of these Regulations.

(3) Part III of Schedule 9 to these Regulations has effect for the purpose of making savings in respect of things done under the Specified Risk Material Order 1997 M3 having effect at the coming into force of these Regulations.

(4) Part IV of Schedule 9 to these Regulations has effect for the purpose of making savings in respect of things done under the Specified Risk Material Regulations 1997 M4 having effect at the coming into force of these Regulations.

(5) Part V of Schedule 9 to these Regulations has effect for the purpose of making savings in respect of things done under the Fertilisers (Mammalian Meat and Bone Meal) (Conditions of Manufacture) Regulations 1998 M5 having effect at the coming into force of these Regulations.

(6) Part VI of Schedule 9 to these Regulations has effect for the purpose of making savings in respect of things done under the Sheep and Goats Spongiform Encephalopathy Order 1998 M6,the Sheep and Goats Spongiform Encephalopathy Regulations 1998 M7 and the Sheep and Goats Spongiform Encephalopathy (Compensation) Order 1998 M8, having effect at the coming into force of these Regulations.

(7) Part VII of Schedule 9 to these Regulations has effect for the purpose of making savings in respect of things done under the Bovine Spongiform Encephalopathy (Feeding Stuffs and Surveillance) Regulations 1999 M9 having effect at the coming into force of these Regulations.

(8) Part VIII of Schedule 9 to these Regulations has effect for the purpose of making savings in respect of things done under the BSE Monitoring (Scotland) Regulations 2001 M10 having effect at the coming into force of these Regulations.

(9) Part IX of Schedule 9 to these Regulations has effect for the purpose of making savings in respect of things done under the Processed Animal Protein (Scotland) Regulations 2001 M11 having effect at the coming into force of these Regulations.
