The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 19721 and section 40 of the Town and Country Planning (Scotland) Act 19972 and of all other powers enabling them in that behalf, and having taken into account the selection criteria in Annex III to Council Directive 85/337/EEC3 as amended by Council Directive 97/11/EC4, hereby make the following Regulations:
