The Scottish Ministers, in exercise of the powers conferred by sections 12A(1) and 105(6) of and paragraph 25(1) of Schedule 7A to the National Health Service (Scotland) Act 1978(1) and of all other powers enabling them in that behalf, having received an application(2) from the Lothian University Hospitals National Health Service Trust and after completion of the consultation prescribed under paragraph 25(3) of the said Schedule 7A(3), hereby make the following Order:
1. This Order may be cited as the Lothian University Hospitals National Health Service Trust (Dissolution) Order 2003 and shall come into force on 1st January 2004.
2. The Lothian University Hospitals National Health Service Trust is hereby dissolved.
3. The Orders specified in the Schedule are hereby revoked.

This Order provides by article 2 for the dissolution on 1st January 2004 of the Lothian University Hospitals National Health Service Trust. As a consequence of that dissolution this Order also revokes the Order establishing that trust and Orders amending the establishment Order, which are all detailed in the Schedule.
1978 c. 29; section 12A(1) was inserted by the National Health Service and Community Care Act 1990 (c. 19) (“the 1990 Act”), section 31 and extended and amended by the Health Act 1999 (c. 8), section 46; section 108(1) contains a definition of “prescribed” relevant to the exercise of the statutory power under which this instrument is made; Schedule 7A was inserted by the 1990 Act, Schedule 6. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
