The Scottish Ministers, in exercise of the powers conferred by section 21(2) and (3) of the Public Appointments and Public Bodies etc. (Scotland) Act 2003(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation

1.  This Order may be cited as the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Commencement No. 6) Order 2004.

Commencement

2.  6th May 2004 is the day appointed for the coming into force of the following provisions of the Public Appointments and Public Bodies etc. (Scotland) Act 2003:–

(a)section 4(c);

(b)section 17, insofar as it relates to the provisions in schedule 4 specified in paragraph (c); and

(c)paragraphs 5(3) and (17) and 17(a)(i) of schedule 4.

Explanatory Note

(This note is not part of the Order)

This Order brings into force sections 4(c) and 17 (partially) of, and paragraphs 5(3) and (17) and 17(a)(i) of schedule 4 to, the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (“the Act”) relating to the Scottish Hospital Trust.

Article 2(a) brings into force section 4(c) of the Act which dissolves the Scottish Hospital Trust.

Article 2(b) and (c) brings into force consequential amendments to the National Health Service (Scotland) Act 1978 (c. 29) and the Freedom of Information (Scotland) Act 2002 (asp 13) which remove references to the Scottish Hospital Trust.
