Their Lordships, in exercise of the powers conferred upon Them by sections 45 and 60 of the Further and Higher Education (Scotland) Act 19921 and of all other powers enabling Them in that behalf, are pleased to order, and it is hereby ordered, as follows:

Citation and commencement1

This Order may be cited as the Edinburgh College of Art (Scotland) Order of Council 1995 (Amendment) Order of Council 2005 and shall come into force on 1st July 2005.

Amendment of the Edinburgh College of Art (Scotland) Order of Council 19952

The Edinburgh College of Art (Scotland) Order of Council 19952 is amended in accordance with this article.

In articles 4(1)(c), 5(1)(b), 6(1) and (2) and 11(e), and in paragraphs 1(b) and 2(b) of Schedule 1 wherever it appears delete “full-time”.

In paragraph 2(d) of Schedule 1 where it first appears delete “full-time”.

In paragraphs 1(b) and 2(b) of Schedule 1, before “matriculated students” insert “full time”.

This Order amends the Edinburgh College of Art (Scotland) Order of Council 1995 (“the 1995 Order”). The 1995 Order makes provision for the constitution, functions and powers of the Board of Governors of the Edinburgh College of Art, as governing body of that College, and the arrangements to be adopted by it in discharging its functions.

The Edinburgh College of Art is an institution designated by the Scottish Ministers as eligible to receive support from the Scottish Higher Education Funding Council.

The 1995 Order is amended to reflect the fact that all employees, whether full or part-time, should be eligible to vote and to stand for election to serve on the Board of Governors and the Academic Council of the College.
