The Financial Assistance for Environmental Purposes (Scotland) Order 2005

The Scottish Ministers, in exercise of the powers conferred by section 153(4) of the Environmental Protection Act 1990(1) and of all other powers enabling them in that behalf, hereby make the following Order:

Citation, commencement and extent

1.—(1) This Order may be cited as the Financial Assistance for Environmental Purposes (Scotland) Order 2005 and shall come into force on 1st July 2005.

(2) This Order extends to Scotland only.

Variation of section 153(1) of the Environmental Protection Act 1990

2.  Section 153(1) of the Environmental Protection Act 1990(2) (purposes for which financial assistance may be given) is varied by adding after paragraph (tt)–

(uu)the scheme known as the Bio-energy Infrastructure Scheme for Scotland..

Explanatory Note

(This note is not part of the Order)

This Order varies section 153(1) of the Environmental Protection Act 1990 so as to enable the Scottish Ministers to give financial assistance to, or for the purposes of, the Bio-energy Infrastructure Scheme for Scotland.
