Sections 105(2) (further provision as to sexual offences prevention orders) and 112(1)(e) and (f) (certain modifications to sections 104 and 106 to 109 for Scotland) of the 2003 Act shall continue to have effect as if this Order had not been made, in a case to which paragraph (2) applies.

This paragraph applies to any application for a sexual offences prevention order or for the variation, renewal or discharge of such an order, provided the application was made before 7th October 2005.

Paragraphs 45 and 46 of Schedule 3 to the 2003 Act (offences which make a person subject to the requirements of Part 2 of that Act) shall continue to have effect as if this Order had not been made, in a case to which paragraph (4) applies.

This paragraph applies to persons who are subject to the requirements of Part 2 of the 2003 Act as at 6th October 2005 by virtue of paragraphs 45 or 46 of Schedule 3 to the 2003 Act.
