Coming into force in accordance with article 1(2) and (3)
The Scottish Ministers, in exercise of the powers conferred by section 3(2) and (3) of the Public Appointments and Public Bodies etc. (Scotland) Act 2003(1) and of all other powers enabling them in that behalf, hereby make the following Order, a draft of which has, in accordance with section 18(4) of that Act, been laid before and approved by resolution of the Scottish Parliament:
1.—(1) This Order may be cited as the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (Treatment of Public Transport Users' Committee for Scotland as Specified Authority and Amendment of Specified Authorities) Order 2006.
(2) This Order, except as provided in paragraph (3), shall come into force on the day after the day on which it is made.
(3) Article 3 shall come into force on 1st January 2007.
2. The Public Transport Users' Committee for Scotland shall be treated, for the purposes of or in connection with any appointment to that body, as if it were a specified authority within the meaning of section 2(1) of the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (the Commissioner’s functions).
3. In schedule 2 to the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (authorities appointments to which are governed by a code of practice) under the heading “Advisory Bodies” insert at the appropriate place “Public Transport Users' Committee for Scotland”.

This Order provides that the Public Transport Users' Committee for Scotland shall, for the purposes of appointments to this body, be treated as if it is a specified authority listed in schedule 2 to the Public Appointments and Public Bodies etc. (Scotland) Act 2003 (asp 4) and subsequently amends schedule 2 to that Act to add this body to the list of specified authorities.
