Their Lordships, in exercise of the powers conferred upon them by sections 45 and 60 of the Further and Higher Education (Scotland) Act 19921 and of all other powers enabling them in that behalf, order as follows:

Citation, commencement and interpretation1

This Order may be cited as the Robert Gordon University (Scotland) Amendment Order of Council 2006 and shall come into force on 21st July 2006.

In this Order–

  • “the 1993 Order” means The Robert Gordon University (Scotland) Order of Council 19932; and

  • “the 2006 Order” means the Robert Gordon University (Scotland) Order of Council 20063.

Amendments to the Robert Gordon University (Scotland) Order of Council 20062

The 2006 Order is amended in accordance with paragraphs (2) and (3).

In article 2 (interpretation), in the definition of “Independent Governor”, after “appointment” insert “or election”.

In article 9 (validity of proceedings of the Board), after “appointment” each time it occurs, insert “or election”.

The Robert Gordon University (Scotland) Order of Council 19933

The revocation of the 1993 Order by article 15 of the 2006 Order is revoked.

The 1993 Order is revived for the purpose of its continuing application in relation to the Institution and the Governing Body (within the meaning of the 1993 Order) of the Robert Gordon University4.

The 1993 Order so revived shall be revoked with effect from the date of the coming into force of an order made under section 47 of the Further and Higher Education (Scotland) Act 1992 closing the Institution and winding up the Governing Body (within the meaning of the 1993 Order) of the Robert Gordon University, as referred to in paragraph (2).

The savings and transitional provisions in article 14 of the 2006 Order shall apply to that revocation under paragraph (3).

This Order amends, and makes transitional provision in relation to, the Robert Gordon University (Scotland) Order of Council 2006 (“the 2006 Order”).

Article 2 makes provision for minor amendments to the governance arrangements for the Robert Gordon University (formerly known as the Robert Gordon Institute of Technology and whose name was changed in accordance with section 49 of the Further and Higher Education (Scotland) Act 1992 by resolution of the Governing Body on 18th March 1992 and consent of the Privy Council on 12th June 1992) contained in the 2006 Order.

Article 3 reinstates the revoked Robert Gordon University (Scotland) Order of Council 1993 for a transitional period. This maintains the governance arrangements for The Robert Gordon University Institution which is to be closed by order under section 47 of the Further and Higher Education (Scotland) Act 1992, until that closure (and the transfer by that order of the assets and liabilities of the Institution to the reconstituted University). This corrects an omission in the 2006 Order.
