The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972(1) and of all other powers enabling them in that behalf, hereby make the following Regulations:
1. These Regulations may be cited as the Animals and Animal Products (Import and Export) (Scotland) Amendment (No. 2) Regulations 2006 and shall come into force on 2nd September 2006.
2.—(1) The Animals and Animal Products (Import and Export) (Scotland) Regulations 2000(2) are amended in accordance with the following paragraph of this regulation.
(2) After the entry for Commission Decision 99/558/EC in paragraph 5 of Part II of Schedule 5 (Registered horses for racing etc.) insert–
“Commission Decision 2006/542/EC (O.J. No. L214, 4.8.2006, p.59),”.

These Regulations amend the Animals and Animal Products (Import and Export) (Scotland) Regulations 2000. They implement Commission Decision 2006/542/EC on animal health conditions and veterinary certification for the re-entry of registered horses for racing, competition and cultural events after temporary export (O.J. No. L214, 4.8.2006, p.59) (regulation 2(2)).
1972. c.68. Section 2(2) was amended by the Scotland Act 1998 (c. 46), Schedule 8, paragraph 15(3). The functions conferred on the Minister of the Crown under section 2(2) of the 1972 Act, insofar as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.
