Act of Sederunt (Fees of Shorthand Writers in the Sheriff Court) (Amendment) 2006

The Lords of Council and Session, under and by virtue of the powers conferred upon them by section 40 of the Sheriff Courts (Scotland) Act 19071 and of all other powers enabling them in that behalf, do hereby enact and declare:

Citation and commencement1.

(1)

This Act of Sederunt may be cited as the Act of Sederunt (Fees of Shorthand Writers in the Sheriff Court) (Amendment) 2006 and shall come into force on 1st May 2006.

(2)

This Act of Sederunt shall be inserted in the Books of Sederunt.

Increase in fees of shorthand writers2.

(1)

The Table of Fees set out in the Act of Sederunt (Fees of Witnesses and Shorthand Writers in the Sheriff Court) 19922 shall be amended in accordance with the following sub-paragraph.

(2)

In Schedule 2 (shorthand writers' fees)–

(a)

in paragraph 1 (attendance), for the amounts of £32.68 and £130.66 there shall be substituted the amounts of £33.81 and £135.17 respectively;

(b)

in paragraph 4 (transcripts), for the amounts of £5.35 and £6.55 there shall be substituted the amounts of £5.53 and £6.78 respectively; and

(c)

in paragraph 5 (copies), for the amount of £0.43 there shall be substituted the amount of £0.44.

Saving3.

Paragraph 2 of this Act of Sederunt shall not affect fees chargeable for work done, or outlays incurred, before 1st May 2006.

This Act of Sederunt increases the fees payable to shorthand writers in the Sheriff Court by 3.45%. The last increase was effected by the Act of Sederunt (Fees of Shorthand Writers in the Sheriff Court) (Amendment) 2005 (S.S.I. 2005/150).

This Act of Sederunt does not apply to fees chargeable for work done before it comes into force.
