This Order brings into force the remaining provisions of the Scottish Schools (Parental Involvement) Act 2006 (“the Act”). Schedule 1 to the Order, introduced by article 2(a), provides for section 23 of the Act, together with the schedule to the Act, being brought into force on 5th February 2007, for the purpose of the repeal of sections 87A (appointment of principal teachers) and 87B (selection of teachers) of the Education (Scotland) Act 1980. Those sections were inserted by section 74 of the Self Governing Schools etc. (Scotland) Act 1989. Section 87A was suspended by section 50 of the Local Government in Scotland Act 2003 (2003 asp 1). The Local Government in Scotland Act 2003 (Principal Teachers) Order 2003 (S.S.I. 2003/607) substituted for the one year period specified in section 50 during which the requirement of section 87A to advertise a vacant principal teacher post is suspended, a further period, which expires on 10th February 2007. This Order brings into force provision for repeal of section 87A, together with section 87B, which relates to the selection of teachers, on 5th February 2007. Section 14 is brought into force on the same date for the purpose of making regulations. All of the Act’s remaining provisions are otherwise brought into force on 1st August 2007. This is provided for by article 2(b), which introduces Schedule 2 to the Order.
