PART 4The collection, processing and storage of semen

Entry of bovine animals to F1licensed quarantine centres, F1licensed collection centres, domestic collection centres or to unlicensed premises22.

(1)

No person may introduce a bovine animal into–

(a)

F2a licensed quarantine centre;

(b)

F2a licensed collection centre; or

(c)

a domestic collection centre,

without the authorisation of the centre veterinarian.

(2)

The centre veterinarian may not authorise a bovine animal to enter F2a licensed quarantine centre unless, prior to its entry to the centre, it always belonged to a herd–

(a)

officially tuberculosis free; and

(b)

officially brucellosis free,

in accordance with F3the text before paragraph 1, paragraph 1 and paragraph 2 of Annex A.1 and the text before paragraph 1, paragraph 1 and paragraph 2 of Annex A.2 to Directive 64/432/EEC.

(3)

The centre veterinarian may not authorise a bovine animal to enter F2a licensed collection centre unless the requirements of Part 1 of Schedule 8 are met.

(4)

The centre veterinarian may not authorise a bovine animal to enter a domestic collection centre unless the requirements of Part 1 or 2 of Schedule 8 are met.

(5)

The operator of unlicensed premises may not collect semen from a bovine animal on unlicensed premises unless the requirements of Part 1 or 2 of Schedule 8 are met.

(6)

The centre veterinarian of F2a licensed collection centre or domestic collection centre, or the operator of unlicensed premises, may not admit bovine animals unless on the day of movement the premises of origin–

(a)

are situated in the centre of an area of 10 kilometres radius in which there has been no case of foot and mouth disease for at least the preceding 30 days;

(b)

have, for at least the preceding 3 months, been free from foot and mouth disease and brucellosis; and

(c)

have, for at least the preceding 30 days, been free from those bovine diseases listed in Annex E(I) to Directive 64/432/EEC.

The centre veterinarian or the operator of unlicensed premises may not authorise the admission of any bovine animal which shows any clinical sign of disease on the day of the proposed admission.

(a)

the text before paragraph 1, paragraph 1 and paragraph 2 of Annex A.1 to Directive 64/432/EEC are to be read as if—

(i)

the references to “competent authority” and “competent authority of a Member State” include

(aa)

in relation to Scotland, the Scottish Ministers,

(bb)

in relation to another part of the United Kingdom, an equivalent authority under legislation in force in that part of the United Kingdom;

(ii)

the reference to “on its own territory” includes territory in the United Kingdom,

(iii)

the reference to “in a Member State” were omitted,

(iv)

the references to “the Member State or part of the Member State” and “the Member State or a part thereof” include the United Kingdom or part of the United Kingdom,

(b)

the text before paragraph 1, paragraph 1 and paragraph 2 of Annex A.2 to Directive 64/432/EEC are to be read as if—

(i)

the references to “competent authority” and “competent authority of a Member State” include

(aa)

in relation to Scotland, the Scottish Ministers,

(bb)

in relation to another part of the United Kingdom, an equivalent authority under legislation in force in that part of the United Kingdom;

(ii)

the reference to “the Member State or part of the Member state” includes the United Kingdom or part of the United Kingdom,

(iii)

the references to “Member States, or regions of Member States” and “that Member State or region” include the United Kingdom or region of the United Kingdom.
