Revocation of an approval or licence35

The Scottish Ministers may revoke an approval or licence granted under these Regulations in whole or in part if–

a

they have notified their decision to suspend the approval or licence and the period for review under regulation 36 has expired;

b

they have upheld their decision to suspend following an review under regulation 36;

c

they have previously suspended the approval or licence and there is further non compliance with these Regulations; or

d

they are satisfied that the occupier no longer uses the premises for the purpose for which a licence was granted.

Notification of a revocation must–

a

be in writing;

b

state what it applies to;

c

state when it comes into effect;

d

give reasons; and

e

in the case of a revocation under paragraph (1)(c) or (1)(d), explain the right of the person who has been notified to request a review of the decision to revoke an approval or licence under regulation 36.

If a person does request a review under regulation 36, the revocation remains in force pending the outcome of the review.
