The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 27(1) and (2), 105(7) and 108(1) of the National Health Service (Scotland) Act 1978(1) and all other powers enabling them to do so.

Citation and commencement

1.  These Regulations may be cited as the National Health Service (Pharmaceutical Services) (Scotland) Amendment (No. 2) Regulations 2007 and come into force on 1st October 2007.

Amendment of the National Health Service (Pharmaceutical Services) (Scotland) Regulations 1995

2.  Paragraph 3(3A) of Schedule 1 to the National Health Service (Pharmaceutical Services) (Scotland) Regulations 1995(2) is amended as follows–

(a)in sub sub paragraph (a) for “National Health Service (Charges for Drugs and Appliances) (Scotland) Regulations 2007(3)” substitute “National Health Service (Charges for Drugs and Appliances) (Scotland) (No. 2) Regulations 2007(4)”; and

(b)in paragraph (b) and (c) for “(f)” substitute “(g)”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the National Health Service (Pharmaceutical Services) (Scotland) Regulations 1995 (“the principal Regulations”) which regulate the provision of pharmaceutical services under the National Health Service (Scotland) Act 1978.

Regulation 2 amends paragraph 3(3A) of Schedule 1 to the principal Regulations.

Sub paragraph (a) of regulation 2 substitutes reference to the National Health Service (Charges for Drugs and Appliances) (Scotland) (No. 2) Regulations 2007 for the existing reference to the National Health Service) (Charges for Drugs and Appliances) Regulations 2007 in sub paragraph (a) of paragraph 3(3A), as a consequence of the revocation of the latter and their replacement by the former.

Paragraph (b) of regulation 2 amends sub paragraphs (b) and (c) of paragraph 3(3A) as a consequence of the insertion of a new category of exemption from charges in sub paragraph (g) of regulation 7(1) of the National Health Service (Charges for Drugs and Appliances) (Scotland) (No. 2) Regulations 2007.

The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46).
