The Crofting Reform etc. Act 2007 (Commencement No. 2) Order 2007

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 28th January 2008 all the provisions of the Crofting Reform etc. Act 2007 not already in force. These largely make amendments to the Crofters (Scotland) Act 1993 (“the 1993 Act”).

New provisions are inserted into the 1993 Act to provide for the application process for approval or consent from the Crofters Commission (“the Commission”) and to provide that the Commission holds and maintains specified information on the Register of Crofts. Amendments to various provisions of the 1993 Act are made setting out circumstances where approval or consent of the Commission is required.

The Succession (Scotland) Act 1964 is amended with respect to prior rights on intestacy in relation to tenancy of a croft and transfer of a croft by an executor.

The Crofting Reform etc. Act 2007 received Royal Assent on 1st March 2007. The first commencement order, the Crofting Reform etc. Act 2007 (Commencement No. 1) Order 2007 (S.S.I. 2007/269), was made on 27th March 2007.
