The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 87(1)(a) of the Sexual Offences Act 2003(1) and all other powers enabling them to do so.

Citation, commencement and extent

1.—(1) These Regulations may be cited as the Sexual Offences Act 2003 (Prescribed Police Stations) (Scotland) Regulations 2008 and come into force on 6th May 2008.

(2) These Regulations extend to Scotland only.

Prescribed Police Stations

2.  The police stations listed in Schedule 1 to these Regulations are prescribed for the purposes of section 87(1)(a) (method of notification and related matters) of the Sexual Offences Act 2003.

Revocation

3.  The Regulations specified in Schedule 2 to these Regulations are hereby revoked.

Explanatory Note

(This note is not part of the Regulations)

Section 87(1) of the Sexual Offences Act 2003 provides that a sex offender who is subject to the notification requirements in Part 2 of that Act fulfils their requirements by attending any police station in their local police area which is prescribed for this purpose in regulations.

These Regulations revoke the Sexual Offences Act 2003 (Prescribed Police Stations) (Scotland) Regulations 2004 (“the 2004 Regulations”) and prescribe a consolidated list of police stations for this purpose for each police area in Scotland. In comparison with the list of prescribed police stations maintained under the 2004 Regulations, these Regulations remove Caithness Police Station and add Wick Police Station as prescribed police stations in the Northern Police Area. Glasgow West End Police Station in Glasgow also becomes a prescribed police station in the Strathclyde Police Area.

2003 c. 42. The functions of the Secretary of State were, so far as exercisable within devolved competence, transferred to the Scottish Ministers by virtue of section 142(6) of the Sexual Offences Act 2003 and section 53 of the Scotland Act 1998 (c. 46).
