Coming into force
The Scottish Ministers make the following Order in exercise of the powers conferred by section 145 of the Licensing (Scotland) Act 20051 and all other powers enabling them to do so.
Citation and commencement1
This Order may be cited as the Licensing (Transitional Provisions) (Scotland) Order 2008 and comes into force on 18th June 2008.
Modification of the Licensing (Scotland) Act 19762
Where an application for provisional grant of a licence is made under section 26(1) of the Licensing (Scotland) Act 19762 on or after the date of the coming into force of this Order, the applicant shall not be required to submit with that application the certificates specified in section 23(3)(b) and (4) of that Act, but shall do so when making a request to have the grant declared final in accordance with section 26(4) of that Act.
