Coming into force

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 99 of the Antisocial Behaviour etc. (Scotland) Act 20041 and of all other powers enabling them to do so.

Citation and commencement1

These Regulations may be cited as the Private Landlord Registration (Advice and Assistance) (Scotland) Amendment Regulations 2008 and come into force on 12th February 2009.

Amendment to the Private Landlord Registration (Advice and Assistance) (Scotland) Regulations 20052

The Private Landlord Registration (Advice and Assistance) (Scotland) Regulations 20052 are amended in accordance with the following paragraph.

After regulation 4(3) (advice and assistance – tenants) insert–

Where a person who is, or who is considering becoming, a tenant approaches a local authority to enquire about letting practice or landlord registration, the local authority must provide to the person general advice in relation to those matters.

These Regulations amend the Private Landlord Registration (Advice and Assistance) (Scotland) Regulations 2005 to make provision for general advice to be provided by the local authority to persons who are, or who are considering becoming, tenants, adding to the provisions already made in relation to the registration of private landlords under Part 8 of the Antisocial Behaviour etc. (Scotland) Act 2004.

A Regulatory Impact Assessment has been prepared covering these Regulations.
