The Scottish Ministers make the following Order in exercise of the powers conferred by section 59(2) of the Planning etc. (Scotland) Act 2006(1).
1.—(1) This Order may be cited as the Planning etc. (Scotland) Act 2006 (Commencement No. 9) Order 2009.
(2) In this Order–
“the 1997 Act” means the Town and Country Planning (Scotland) Act 1997(2);
“the Act” means the Planning etc. (Scotland) Act 2006; and
“the Schedule” means the Schedule to this Order.
2.—(1) Subject to paragraph (2) the provisions of the Act specified in column 1 of the Schedule (and the subject matter of which is described in column 2 of the Schedule), to the extent not already in force, come into force on 3rd August 2009 for all purposes.
(2) Where a purpose is specified in column 3 of the Schedule in relation to any provision, that provision shall, to the extent not already in force, come into force on 3rd August 2009 only for that purpose.

To the extent they are not already in force, this Order brings sections 6 to 10 (other than section 7(3)), 12 to 15, 16(b), 17 to 22 (other than section 20(3)), 25, 26, 54(3) to (10), (13) and (17)(a)(i) and 56 of and the Schedule (partially) to the Planning etc. (Scotland) Act 2006 (“the Act”) into force on 3rd August 2009 for all purposes.
Article 2(2) limits the purposes for which the Schedule to the Act is commenced on 3rd August 2009.
