Coming into force
The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972 M1 and all other powers enabling them to do so.
These Regulations make provision for a purpose mentioned in section 2(2) of the said Act and it appears to the Scottish Ministers that it is expedient for the references to Community instruments set out in Schedule 1 to the Products of Animal Origin (Third Country Imports) (Scotland) Regulations 2007 M2 to be construed as references to those instruments as amended from time to time.

Citation, commencement and interpretation1

These Regulations may be cited as the Products of Animal Origin (Third Country Imports) (Scotland) Amendment Regulations 2009 and come into force on 26th June 2009.

In these Regulations “the 2007 Regulations” means the Products of Animal Origin (Third Country Imports) (Scotland) Amendment Regulations 2007.

The 2007 Regulations are amended as follows.

In regulation 4 (exemption for authorised products and personal imports) for paragraphs (7) and (8) substitute–

Part 3, with the exception of regulation 25, and Parts 4 to 9 do not apply to products of animal origin specified in Article 2 of Commission Regulation (EC) No. 206/2009 on the introduction into the Community of personal consignments of products of animal origin and amending Regulation (EC) No. 136/2004M3.

For Schedule 1 (import conditions) substitute the Schedule set out in the Schedule to these Regulations.
Revocation3
The Products of Animal Origin (Third Country Imports) (Scotland) Amendment (No. 2) Regulations 2006 M4 are revoked.

All references to Community instruments in this Schedule are references to those instruments as amended from time to time.
1972 c. 68. Section 2(2) was amended by the Scotland Act 1998 (c. 46) (“the 1998 Act”), Schedule 8, paragraph 15(3), and the Legislative and Regulatory Reform Act 2006 (c. 51) (“the 2006 Act”), section 27(1). Paragraph 1A of Schedule 2 was inserted by section 28 of the 2006 Act. The functions conferred upon a Minister of the Crown under section 2(2) of the European Communities Act 1972, insofar as exercisable within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the 1998 Act.
