The Offences (Aggravation by Prejudice) (Scotland) Act 2009 (Commencement) Order 2010

The Scottish Ministers make the following Order in exercise of the powers conferred by section 3(1) of the Offences (Aggravation by Prejudice) (Scotland) Act 2009(1) and all other powers enabling them to do so.

Citation

1.  This Order may be cited as the Offences (Aggravation by Prejudice) (Scotland) Act 2009 (Commencement) Order 2010.

Appointed Day

2.  The appointed day for the coming into force of the provisions of the Offences (Aggravation by Prejudice) (Scotland) Act 2009, in so far as they are not already in force, is 24th March 2010 in respect of offences committed on or after that date.

EXPLANATORY NOTE

(This note is not part of the Order)

The Order brings into force the remaining provisions of the Offences (Aggravation by Prejudice) (Scotland) Act 2009 (“the Act”).

Section 1 of the Act, which makes provision relating to offences aggravated by prejudice relating to disability, is brought into force on 24th March 2010 in respect of offences committed on or after that date.

Section 2 of the Act, which makes provision relating to offences aggravated by prejudice relating to sexual orientation or transgender identity, is brought into force on 24th March 2010 in respect of offences committed on or after that date.

the Act received Royal Assent on 8th July 2009. Section 3 of the Act came into force on Royal Assent. This Order brings into force the remaining provisions of the Act.
