3. Basic Seed is seed—
(a)which has been produced by or under the responsibility of the breeder from uncertified Pre-Basic Seed or Pre-Basic Seed;
(b)is intended for the production of Certified Seed, and
(c)either—
(i)satisfies the requirements for Basic Seed set out in Schedule 4 and in respect of which–
(aa)an official certificate has been issued in accordance with Part I of Schedule 2; or
(bb)a breeder's confirmation has been issued in accordance with Part II of Schedule 2; or
(ii)has been certified by a European Authority other than the Scottish Ministers as satisfying the conditions specified in sub-paragraphs (a) and (b) and Annex I of the Beet Seed Directive.
